TrafFix Devices, Inc., a company with principal offices at 160 Avenida La Pata, San Clemente, CA 92673, is the data controller for the purposes of data protection law. Our data protection officer can be contacted at privacy@traffixdevices.com.
This Privacy Policy explains how TrafFix Devices and its subsidiaries collect, use, and otherwise process information we obtain through your use of our services available on our website www.traffixdevices.com or any other websites, apps, pages, features, or content we own or operate (collectively, the "Services"). The terms "TrafFix", "TDI", "we", and "us" include TrafFix Devices, Inc. and its subsidiaries. This Privacy Policy does not apply to websites that simply name TrafFix Devices or use our Logo or Brand Names.
"Personally Identifiable Information" (PII) refers to any information relating to an identified or identifiable natural person. An identifiable person is someone who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, address, email address, telephone number, an identification number, location data, online identifier or to one or more factors specific to the physical, psychological, genetic, mental, economic, cultural or social identity of that person.
By using these Services, you confirm that you have read and understand the Privacy Policy and acknowledge that we will process Personally Identifiable Information in accordance with this Privacy Policy.
TrafFix Devices, Inc. reserves the right to modify this Privacy Policy at any time in its sole and absolute discretion.
Overview
Any person interacting with TrafFix Services who provide TrafFix with names, addresses, telephone numbers, e-mail addresses, domain names or URLs, or any other PII permits TrafFix to use such information for commercial purposes of its own, including contacting individuals about products and services which may be of interest. The only Personally Identifiable Information we collect is volunteered by the user of the Services, including form submittals, site registrations, and purchases. This information is used to conduct business, improve customer satisfaction, website reliability, and is never shared with other organizations for commercial purposes.
Passive Information Collection
We track visitors movements through our Services using cookies from Google Tag Manager (GTM) with Google Analytics (GA), unless a "Do Not Track" signal has been received. Rest assured, we have setup these cookies to collect information in an anonymous fashion and provide us with useful information; such as number of visitors, their general location, which pages are visited, and the browser and operating system of the device used. This information is used to better understand how users interact with the Services so we can enhance customer experience in the future.
OFF "Do Not Track" Preferences
We respect your right to online privacy. As such, our Services monitor for and behave differently if your device or browser transmits a "Do Not Track" (DNT) or similar message. When our Services receive a DNT signal, we won't track or record your visit, no tracking cookies will be created, nor will we collect any personally identifiable information about you or your device unless you volunteer such information through purchases, site registrations, or otherwise submitting information to the Services.
To reduce spam and other unintended uses of the Services any device or browser transmitting a DNT signal will receive a new Session Cookie with each page view, form submittal, or other request sent to the Services.

Order Fulfillment
We may provide your personal information to trusted third-party companies that provide services to fulfill your order, such as fraud detection and investigation, payment processing, order shipping, and address validation. These companies are authorized to use your personal information only as necessary to provide these services to us. These services include:

- FedEx (address validation and shipping service)

Children Online Privacy Protection Act (COPPA)
When it comes to the collection of personal information from children under the age of 13 years old, the Children's Online Privacy Protection Act (COPPA) puts parents in control. The United States Federal Trade Commission (FTC) enforces the COPPA Rule, which spells out what operators of websites and online services must do to protect children's privacy and safety online.
We do not specifically market to children under the age of 13 years old, nor do we allow third-parties, including ad networks, contractors, or payment processors to collect PII from children under 13.
California Online Privacy Protection Act (CalOPPA)
CalOPPA is California state law requiring commercial websites and online services to post a privacy policy. The law's reach stretches well beyond California to require any person or company in the United States that operates websites collecting Personally Identifiable Information from California consumers to post a conspicuous privacy policy on its website stating exactly the information being collected and those individuals or companies with whom it is being shared.
European Union Residents
We take your privacy very seriously and have taken steps to comply with the requirements defined in the European Union General Data Protection Regulation (GDPR) that went into effect on May 25, 2018. These requirements are outlined throughout this Privacy Policy. GDPR requires a lawful basis for collection and retention of personal information from citizens and residents of the European Economic Area. Our lawful bases include:
- Contract: In order to fulfill the contract we have with you to provide the products and/or services that you requested, we need to use your personal data to charge your payment, ship goods to you, and to communicate with you before, during, and after our interactions.
- Legal Obligation: We may need your data to comply with customs requests or to maintain tax audit records.
- Legitimate Interests: We have a fair and good reason to use your data in ways that are reasonably expected as part of conducting business and that do not impact your rights, freedoms, or interests.
Please note that while any requested changes will be reflected in our database as soon as possible, unmodified information may be retained for a period of time in backups or archives to prevent fraud and abuse, for audit and compliance records, or where we otherwise reasonably believe that we have a legitimate reason to do so.
Data Retention
We will retain your information for as long as your account is active or as needed to provide you with goods and/or services, as necessary to comply with our legal obligations, to resolve disputes, and to enforce agreements. We also collect and maintain aggregated, anonymized information which we may retain beyond our interactions, possibly indefinitely, to protect the safety and security of our information technology, improve our Services, or to comply with legal obligations.
Reviewing, Deleting, or Updating Your Personal Information
At any time prior to the shipment of your order, you may withdraw your consent to process your data by contacting us and we will cancel your order. Once an order has been shipped, we are unable to cancel or otherwise halt the processing of your data; however, you have the right to access, correct, delete, or obtain a copy of your data at any time by contacting us.
